Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer may exercise the right of withdrawal.
  • Consumer: the natural person who is not acting for purposes related to his or her trade, business, craft or profession.
  • Day: calendar day.
  • Durable medium: any means that enables the consumer or All Perfectly Pierced to store information in such a way that it can be consulted at a later time and reproduced unchanged.
  • Right of withdrawal: the right of the consumer to withdraw from a distance contract within the statutory cooling-off period.
  • Entrepreneur: All Perfectly Pierced, the business offering products through the webshop.
  • Distance contract: a contract concluded through the webshop, without the consumer and the entrepreneur being physically present at the same time.
  • Product: any item offered through the All Perfectly Pierced webshop, including piercing jewelry, accessories and related products.
  • Hygiene product: a product which, for reasons of health protection or hygiene, is not suitable for return once the seal has been broken after delivery.

Article 3 – Applicability

  1. These terms and conditions apply to every offer made by All Perfectly Pierced and to every distance contract concluded through the webshop between All Perfectly Pierced and the consumer.
  2. Before the contract is concluded, these terms and conditions will be made available to the consumer in a clear manner.
  3. If additional product terms or service terms apply alongside these terms and conditions, this will be clearly stated. If provisions differ from each other, the provision most favourable to the consumer will apply, unless otherwise permitted by law.
  4. These terms and conditions relate to purchases made through the webshop. For services provided in the studio, such as the placement of piercings, additional terms, consent forms, hygiene protocols and aftercare instructions may apply.

Article 4 – The offer

  1. Every offer is described clearly and carefully.
  2. The product description is sufficiently accurate to allow the consumer to make a proper assessment of the offer.
  3. Images are intended to provide a truthful representation of the products. Minor differences in colour, shape, finish or size may occur, for example with handmade jewelry, natural materials or photography under different lighting conditions.
  4. Obvious mistakes or obvious errors in the offer are not binding on All Perfectly Pierced.
  5. Every offer contains the information necessary to make clear to the consumer which rights and obligations are attached to the purchase.

Article 5 – The contract

  1. The contract is concluded when the consumer accepts the offer and meets the conditions attached to that offer.
  2. When the consumer has accepted the offer electronically, All Perfectly Pierced will confirm receipt of the order by email as soon as possible.
  3. As long as receipt of the order has not been confirmed, the consumer may terminate the contract.
  4. All Perfectly Pierced takes appropriate technical and organisational measures to carefully secure electronic payments and personal data.
  5. Within the limits of the law, All Perfectly Pierced may investigate whether the consumer can meet his or her payment obligations and may refuse an order if there are justified reasons to do so.
  6. Upon or after delivery, the consumer will receive the relevant information about the product, withdrawal, warranty, service, complaints and other legally required information in writing or digitally.

Article 6 – Right of withdrawal

  1. For online purchases, the consumer generally has the right to withdraw from the contract within 14 days after receiving the product, without giving any reason. The statutory cooling-off period for online sales is 14 days. The consumer must be clearly informed about this and a model withdrawal form must be made available.
  2. The cooling-off period starts on the day after the consumer, or a third party designated in advance by the consumer, has received the product.
  3. If an order consists of several products that are delivered separately, the cooling-off period starts on the day after the last product has been received.
  4. During the cooling-off period, the consumer must handle the product and packaging with care. The consumer may only handle the product to the extent necessary to determine its nature, characteristics and functioning.
  5. The consumer may use the model withdrawal form, but is not obliged to do so. Withdrawal may also be communicated through another clear statement, for example by email.

Article 7 – Obligations of the consumer during the cooling-off period

  1. The consumer is liable for any reduction in value of the product if this results from use that goes beyond what is necessary to determine the nature, characteristics and functioning of the product.
  2. Products must, where reasonably possible, be returned unused, undamaged, complete and in their original packaging.
  3. For hygiene products, including piercing jewelry, the right of withdrawal may lapse once the seal has been broken after delivery, if the product is not suitable for return for reasons of health protection or hygiene.

Article 8 – Exclusion of the right of withdrawal

  1. The right of withdrawal is excluded for products:
  2. that have been made according to the consumer’s specifications, such as personalised, specially ordered or custom-made jewelry;
  3. that are clearly personal in nature;
  4. that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, including piercing jewelry;
  5. that by their nature cannot be returned;
  6. for which it is reasonably clear that return is not possible due to hygiene, safety or health protection.

Article 9 – Costs and refunds in the event of withdrawal

  1. The cost of returning products is borne by the consumer, unless stated otherwise.
  2. All Perfectly Pierced will refund all payments made by the consumer, including the original standard shipping costs, no later than 14 days after the consumer has notified All Perfectly Pierced of the withdrawal.
  3. If the consumer has chosen a more expensive delivery method than the cheapest standard delivery, the additional costs for that more expensive delivery method will not be refunded.
  4. All Perfectly Pierced may wait with the refund until the product has been received back or until the consumer has shown proof that the product has been returned.
  5. Refunds will be made using the same payment method used by the consumer for the original payment, unless otherwise agreed.
  6. All Perfectly Pierced does not charge any additional costs for refunds.

Article 10 – The price

  1. All prices in the webshop include VAT, unless expressly stated otherwise.
  2. Any shipping costs, import duties, customs charges or other additional costs will, where applicable, be clearly stated before the consumer places the order.
  3. During the validity period of the offer, prices will not be increased, unless there are changes in VAT rates, legal provisions or obvious errors in the offer.
  4. Price increases after the contract has been concluded are only permitted if this is allowed by law or if the consumer has the right to terminate the contract.

Article 11 – Conformity and statutory warranty

  1. All Perfectly Pierced guarantees that the products comply with the contract, the description in the offer and the reasonable requirements of reliability and usability.
  2. The consumer is entitled to a proper product. If a product does not meet what the consumer could reasonably expect, the statutory warranty rights apply. In the Netherlands, there is no fixed statutory warranty period. The expected lifespan depends on the type of product and what the consumer may reasonably expect from it.
  3. Any manufacturer’s warranties or brand warranties apply in addition to the consumer’s statutory rights and do not limit those rights.
  4. Manufacturer’s warranties on jewelry generally relate to manufacturing defects. Damage caused by improper use, dropping, impact, loss, normal wear and tear, incorrect placement, incorrect removal, insufficient maintenance or contact with aggressive substances is generally not covered.

Article 12 – Delivery and performance

  1. All Perfectly Pierced handles orders with the greatest possible care.
  2. Delivery takes place at the address provided by the consumer.
  3. Orders are delivered as soon as possible, but no later than within 30 days, unless a different delivery period has been agreed.
  4. If delivery is delayed or if an order cannot be fulfilled, or can only be partially fulfilled, the consumer will be notified as soon as possible.
  5. If delivery cannot take place within 30 days and no other delivery period has been agreed, the consumer has the right to terminate the contract free of charge.
  6. The risk of damage to or loss of products lies with All Perfectly Pierced until the product has been delivered to the consumer or to a third party designated in advance by the consumer.
  7. International shipments may be delayed due to customs, carriers or local postal services. All Perfectly Pierced will inform the consumer about this as well as possible and, if necessary, start an investigation with the carrier.

Article 13 – Payment

  1. Payment must be made immediately when placing the order, unless otherwise agreed.
  2. The consumer is obliged to immediately notify All Perfectly Pierced of any inaccuracies in the payment details provided.
  3. When using third-party payment services, such as Klarna, PayPal, Shopify Payments or other payment providers, additional terms from the relevant provider may apply.
  4. Agreements between the consumer and a payment provider, for example regarding payment in instalments or deferred payment, fall outside the responsibility of All Perfectly Pierced.
  5. All Perfectly Pierced remains responsible for the correct processing of the order, but cannot make changes to payment arrangements made directly between the consumer and an external payment provider.

Article 14 – Complaints procedure

  1. Complaints about the performance of the contract, products, delivery or service may be submitted by email via info@allperfectlypierced.nl.
  2. The consumer is asked to describe the complaint fully and clearly, so that All Perfectly Pierced can assess it carefully.
  3. Complaints will be answered within 14 days of receipt. If a substantive response requires more time, the consumer will receive a confirmation of receipt within this period, together with an indication of when a substantive response can be expected.
  4. All Perfectly Pierced will make every effort to resolve complaints carefully, reasonably and in mutual consultation.
  5. If a complaint cannot be resolved in mutual consultation, the consumer may submit the dispute to the competent court or, where applicable, to a recognised dispute resolution body.

Article 15 – Liability

  1. All Perfectly Pierced is not liable for damage caused by incorrect use of products, incorrect application, insufficient maintenance or failure to follow product information, aftercare instructions or safety advice.
  2. To the extent permitted by law, the liability of All Perfectly Pierced is limited to the amount of the relevant order.
  3. This limitation does not apply in cases of intent, deliberate recklessness or liability that cannot be excluded or limited under mandatory law.
  4. For piercings and treatments in the studio, additional information, consent and aftercare procedures apply.

Article 16 – Privacy and personal data

  1. All Perfectly Pierced processes personal data carefully and in accordance with the General Data Protection Regulation.
  2. Personal data is only processed insofar as necessary for the performance of the contract, customer service, legal obligations, security, administration or other legitimate purposes.

Article 17 – Disputes and applicable law

  1. Contracts between All Perfectly Pierced and the consumer are governed by Dutch law.
  2. This choice of law does not affect the mandatory consumer protection to which the consumer is entitled under the law of his or her country of residence, where legally applicable.
  3. Disputes will be submitted to the competent Dutch court, unless mandatory law provides otherwise.

Article 18 – Additional or deviating provisions

  1. Additional or deviating provisions may not be to the detriment of the consumer, unless permitted by law.
  2. Additional or deviating agreements will be recorded in writing or digitally.
  3. If any provision of these terms and conditions is found to be wholly or partially void or voidable, the remaining provisions will remain fully in force. All Perfectly Pierced will replace the relevant provision with a provision that reflects the purpose and scope of the original provision as closely as possible.
